If you do not agree to these Terms, do not use the Service. We may update these Terms at any time by posting the revised version on the Service. Your continued use after any changes constitutes acceptance of the updated Terms.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
You may be required to authenticate via phone number or other methods to access certain features. You are responsible for maintaining the security of your authentication credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Lusiv operates as a marketplace platform connecting event attendees with independent vendors. Lusiv is not a party to any transaction between you and a vendor. Vendors are independent third parties and are solely responsible for their products, services, quality, and fulfillment. Lusiv does not endorse, warrant, or guarantee any vendor's offerings.
All purchases are processed through third-party payment providers. Prices are set by vendors and may include service fees charged by Lusiv. All sales are final unless otherwise stated by the vendor. Lusiv is not responsible for refund disputes between you and a vendor, though we may facilitate communication at our discretion.
Use of the Service at live events is at your own risk. You acknowledge that live events involve inherent risks, including but not limited to crowding, noise, weather, and physical hazards. You voluntarily assume all risks associated with attending and participating in live events where the Service is used. Lusiv is not responsible for any injury, loss, or damage incurred at any event.
All content, trademarks, logos, and software associated with the Service are the property of Lusiv Inc. or its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. By submitting any content to the Service, you grant Lusiv a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, distribute, and display such content in connection with the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LUSIV DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUSIV AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. IN NO EVENT SHALL LUSIV'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO LUSIV IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Lusiv Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Lusiv reserves the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, 11, 12, and 13 shall survive termination.
